Enterprise PII op een startup-budget

Een solo-advocaat beoordeelt wekelijks contracten. Elk contract bevat klantnamen, financiële voorwaarden en belasting-ID's. Voordat een samenvatting wordt gedeeld met co-counsel, moeten die gegevens worden geredigeerd.

De goedkoopste enterprise-tool voor dit kost €500 per maand. De gratis open-source optie vereist een ontwikkelaar om het in te stellen — minimaal €3.000 aan installatietijd.

Geen van beide werkt. Dus wordt de redactie overgeslagen, handmatig gedaan of op inconsistente manieren uitgevoerd. Geen van die voldoet aan GDPR Artikel 32.

Twee markten, één wet

De privacysoftwaremarkt bedient twee segmenten:

Zelf-geleerd open source: Presidio, spaCy. Gratis om te downloaden. Vereist engineeringexpertise, hosting-infrastructuur, doorlopend onderhoud. Effectieve kosten voor teams zonder ML-engineers: €3.000–€10.000 installatiekosten plus doorlopend onderhoud.

Tussen deze twee: niets voor de 23 miljoen mkb-bedrijven in Europa die GDPR-naleving nodig hebben maar geen enterprise-budget of ML-teams hebben.

De kosten van non-compliance

GDPR-boetes zijn niet beperkt tot grote bedrijven. DPA's hebben kleine bedrijven beboet:

  • Een Portugese zorginstelling: €400.000 voor ongeautoriseerde toegang tot patiëntengegevens
  • Een Poolse marketingbedrijf: €220.000 voor het verwerken van gegevens zonder rechtsgrondslag
  • Een Nederlandse rekruteringsbureau: €725.000 voor het bewaren van gegevens langer dan noodzakelijk

Voor een solo-advocaat of klein bureau is een boete van €200.000 een existentieel risico, niet een operationeel probleem.

Wat betaalbare compliance vereist

Een tool die de kloof overbrugt moet:

  1. Geen installatie vereisen: direct bruikbaar, geen engineering
  2. Schalen per gebruik: betaal voor documenten, niet voor een jaarlicentie
  3. Professionele nauwkeurigheid leveren: dezelfde ML-kwaliteit als enterprise-tools
  4. Auditlogboeken opnemen: GDPR vereist documentatie van beschermingsmaatregelen
  5. In de EU gehost zijn: geen gegevensoverdracht buiten EU-jurisdictie
