TikTok案决定了什么

这个案例与数据泄露无关,而是关于用户文件的流向,以及跨境传输的法律依据。

TikTok将欧盟用户文件存储在服务器上,中国员工可以访问这些服务器。GDPR第44-46条限制向没有欧盟充分性决定的国家进行传输,中国没有此类决定。TikTok声称已有适当的技术措施,但监管机构不认可。

教训很明确:仅在欧盟境内托管还不够——如果欧盟以外的员工可以访问这些文件,或者公司必须遵守非充分性国家的法律,这仍不足以满足要求。
